Terms and Conditions for Hire & Safety Regulations 2024
Please read our terms and conditions carefully as this may affect you and your guest experience. And if you don't agree with any of statements DO NOT book with us.
If you decide to make a booking with us using Phone call, Website or any other way and you've paid deposit that means you agree with all terms set out below.
On the delivery time please make sure that person who is responsible to meet us is 18 years old.
1. Definitions:
- 1.1. "The Hirer" - person, organisation placing or their representative who order with Funny Land LTD (You)
- 1.2. "The Company" - Funny Land LTD (us, we)
2. Order:
- 2.1. Placing order (online, by phone, email or any other way) means The Hirer fully understands and agrees The Company Terms and Conditions, Cancelation policy's and gets into a contact with The Company.
- 2.2. In case The Company is not able to fulfil order in any reason (even though online system was showing item availability), The Company will inform you as soon as possible.
- 2.3. When placing order, The Hirer must make sure that they have Land owners or venues permission. If you need copy of our Testing, Insurance or risk assessments feel free to contact us at funnyland.uk@gmail.com . They are available prior booking date.
- 2.4. If any kind forms need to be filled (eg. for venue) The Company will need reasonable and adequate amount of time to fill them.
- 2.5. All equipment shall not be hired out to any other client except The Hirer who hired out to on the booking confirmation without the written consent of the The Company.
3. Delivery:
- 3.1. The Company regular delivery times are from 8am to 2pm and collection times are till 7pm free 10pm for additional charge of 10£ per hour if not per The Company schedule. The Company is making delivery on the large are so we can't guarantee exact timing delivery although The Hirer can still add request and The Company if it's possible will try to fulfill The Hirers request.
- 3.2. In case of any changes from The Hirer in delivery preferences The Hirer have to contact The Company ASAP
- 3.3. In case of any changes from The Company in delivery preferences The Company have to contact The Hirer ASAP
- 3.4. The Hirer is responsible to provide adequate access for the equipment that you are hiring. The Company team is not responsible if we will not be able to deliver / install equipment due to inadequate access. The Hirer will not be eligible for refund.
- 3.5. The Hirer is responsible for any Parking charges. This means The Hirer making order with The Company takes full responsibility for supplying parking space for Van to load and unload equipment while installation/ collection. This includes Parking permit, car park tickets, parking meters, visitors pass or other as necessary.
- 3.6. If there is no parking space close to site or if there is red route, single/double yellow lines and parking space cannot be provided The Hirer must contact The Company BEFORE actual eventand delivery to find best options. (extra charges may apply for example for additional drop off driver) But still if there is no parking space provided and no solution found the delivery will be cancelled with no refund.
- 3.7. If The Company receives parking ticket for a parking space provided, ticket will be sent to The Hirer who by placing order with The Company, takes responsibility to cover full ticket amount.
- 3.8. Before delivery The Hirer must make sure there is no stuff causing obstruction on the way, delivery area is clean of rubbish, pet fouling and other stuff. The Hirer must make sure that area is ready before The Company arrives.
- 3.9. All booked inventory will be delivered, set up and inspected by The Company staff. The Hirer must sign for the delivery by signing our Terms of Hire. Which means The Hirer is happy with location, staff, inventory (meets requirements, fits for purpose and is in good working condition).
- 3.10.Once the equipment has been signed for, any breakages, damages, losses, theft (including overnight) will then be liable for the client to pay the full value for either repair (from 50£) or replacement.
- 3.11.The Hirer is responsible for all equipment during all time from delivery to collection (even if there is collection delay The Hirer is responsible until equipment is collected).
- 3.12.The Hirer must not refuse collection of equipment for any reason.
- 3.13.Due to high demand and precise delivery schedules The Company staff need to be able to get access to set up equipment straight away once arrived. The Hirer is responsible for providing access and can be extra charged for delays at rate of 10£ per 10 minutes. Other option is to delivery to be cancelled with no refund to The Hirer.
- 3.14.If The Hirer wants to extend rent to later finish time or to overnight service The Hirer needs to get in contact with The Company ASAP so we can discuss available options. The Company can accommodate this request if it can be implement according to our delivery schedule and demand, and for additional charge.
- 3.15.If The Hirer chose overnight/later collection option, The Hirer agrees that if collection time is agreed for next day, exact time The Hirer must make sure to be able to give access for The Company team to collect inventory. Failure to respond or attend will result extra charged of Full day hire price being added to your bill. This is due to delay in collection may cause delay or failure to deliver for next client what is unacceptable for The Company.
- 3.16.Due to overnight and late collection service availability this may cause equipment to get wet or little dirty for net day delivery. In this occasion The Company team will be cleaned and wiped out while installation on your place. Drying complete drying may take up to 2 hours (may vary according to weather) so please allow some time (at least 1 hour) before your event for inflatable to get in fully usable condition especially if weather before was wet.
4. Delays / Damages / Breakdowns:
- 4.1. As described before the delivery time are approximate and can vary although The Company will do everything depending on us to fulfill order at scheduled time there is still lots of factors which The Company can't predetermine and control like traffic, vehicle breakdown or delays due caused by previous client, etc. The Company will not be held responsible or liable for any losses or costs incurred by yourselves or any forms of additional compensation. In case of any The Hirers loss of earnings caused, no further compensation will be paid.
- 4.2. To avoid any inconvenience and if it is possible please allow about 2 hours before and after your event when making booking.
- 4.3. Full refund can be applied if equipment gets damaged before event or if fault gets found during installation inspection so the equipment can't fulfill its purpose. The refund amount will be same to price in order invoice, with no extra fees or compensations paid.
- 4.4. Partial refund can be applied if equipment breakdowns during your event and can't fulfill its purpose. Then refund will be calculated depending on remaining time of your booking (according to your start/finish info in your order which we get from you).
- 4.5. Any refund will also be limited to the specific item at fault and not the whole booking.
- 4.6. About any damages or breakdowns, The Hirer must inform The Company immediately via phone call and email. The Company may ask to send video of damaged/broken equipment and if needed will send staff to inspect it, fix it or (if possible) change it for similar / same one
- 4.7. The Company may need up to 2 hours to change equipment from the moment of getting information about situation and only if it is possible according to equipment stock and can be done with existing delivery schedule.
- 4.8. In case of damage / breakdown the decision about amount of refund is at the discretion of The Company.
- 4.9. In case of damage / breakdown, after contact with The Company, The Hirer can keep using equipment ONLY if The Company says it is safe to do so, otherwise The Hirer takes all responsibility for any damages or injuries caused from this point.
- 4.10.Extra fees can apply in case if equipment is returned in dirty, untidy condition (candy wrappers, stickers, confetti, logos, decals, cello tape, face paint etc.). The amount of fee may be from 30£ to 50£ according to real condition and at the discretion of The Company.
- 4.11.All the equipment must be returned in same condition as it was supplied.
5. Ownership and Equipment:
- 5.1. All equipment supplied by The Company to The Hirer remains the property of The Company at all times.
- 5.2. The Company reserves the right to alter, amend or change the product specifications without prior notice.
- 5.3. All sizes and measurements presented are approximate and are to the best of The Company's knowledge.
- 5.4. The Company reserves the right to substitute any booked equipment or service with another similar piece of equipment or service with similar value without prior notice in the event the booked equipment or service is unavailable. The Company will always try to get in touch with The Hirer as soon as possible.
- 5.5. The Company reserves the right to use any images, photos or videos of our equipment or service. Doesn't meter who and where took photo or video and where it is displayed (Facebook, Instagram etc.). The Company is not going to seek permission to use any of these material for our purpose (marketing, product images, soc. media etc.).
- 5.6. The Company reserves the right to make photo or video of equipment while on site during installation / collection and to use them without seeking permission for our future marketing purpose, social media posts etc. also The Company reserves right to use any photos/videos of our equipment regardless of who made them and where these were displayed.
6. Location:
- 6.1. The location of setting up for equipment will be agreed before installation and can’t be changed during event. It is not allowed to turn, move, relocate or any other way change position of equipment as this will make equipment unsafe to use. The Hirer is fully responsible for topic above during from the installation.
- 6.2. The Hirer is fully responsible for the crowd control measures and for suitable security are in place during whole event.
- 6.3. The space required for installation and safe usage of the equipment has to be larger than equipment size (can be found on our website for each equipment piece or by contacting us via Facebook/Instagram/Live chat/Email)
- 6.4. The Hirer is responsible to check in advance sizes of equipment and if The Hirer has enough space for them, also the correct surface to operate the equipment booked, inflatable’s outdoors have to go only onto real grass to ensure they can be anchored down and meet BSEN 14960:2013 fully.
- 6.5. If the surface is not suitable, or space is not enough, or venue isn't suitable to set up or getting to location then delivery will be refused, equipment installation will be cancelled and The Hirer still will be charged for full amount. This includes any provisions the client has failed or forgot to let The Company know like obstructions, stairs or steps, no parking facilities, unsuitable or inadequate space, rough ground surface or if grass is not covering all area, excess distance to the event location (Over 50m.), not working/faulty/ small lift, etc.
- 6.6. The Hirer in advance must make sure that The Company is aware of any kind of underground services present on place where equipment will be installed. This may be pipes (gas, water etc.), wires, drainage systems, irrigation systems, etc. Our equipment to be safely fixed requires fixing using metal pegs inserted to the ground for up to 50cm. deep. This means The Company will not accept responsibility or cost of damage caused by these.
- 6.7. If the delivery needs to go through a house, property or any other area, our delivery team will do their best and will take utmost care while delivering, but any damage caused during delivery/collection process will not be accepted as responsibility of The Company. As described before The Hirer takes all responsibility to provide access to the site, this means The Hirer takes responsibility for this kind of damages as well. We strongly recommend to protect all that needs to be protected (floors, wall corners, etc.), cover everything needs to be covered (cupboards, cabinets, etc.), remove all that can fall or can be damaged (lamps, paintings, decorations, etc.). Make sure the way is without obstacles (toys, carpets, pets, etc.), hooks (furniture handles, etc.) and fragile items so a trolley with the equipment can be wheeled to the required set-up point.
7. Weather:
- 7.1. The Company’s terms are to fulfill all bookings, in any weather conditions. Our service is to provide you with equipment and service as promised. The Company can’t be held responsible for the weather conditions in any form (rain, hot weather etc.) and no refunds or our charge reductions are will be offered. No meter what are weather conditions, The Hirer still will be charged for full price.
- 7.2. The Hirer is responsible to not use our equipment during: heavy rain – The Hirer must wait until rain ends, then dry equipment and only then use it; Strong wind (wind speeds exceed 24mph, or lower for certain types of units, as stated by the trading body The British Inflatable Hirers' Alliance (BIHA)). This is to insure, that all our equipment is operated in safe conditions and risks of accident or injury is minimised. Also tall of this is to ensure that we fully meet the UK law.
- 7.3. During hot weather inflatables and PVC can become extremely hot. If the inflatable becomes too hot it mustn't be used until the temperature has cooled.
8. Power requirements:
- 8.1. The Hirer is responsible for correct and proper power supply. If the power is not supplied than delivery will be cancelled with full amount to pay.
- 8.2. IN CASE OF AN UNEXPECTED ENERGY LOSS FIRST THING TO DO IS TO TAKE OUT EVERYONE OUT OF INFLATABLE and only after everyone are safe you can check what went wrong.
- 8.3. Single unit of our equipment requires 1.5Kw. of electricity which means we need 1 – 13amp. 3 pin plug or a 1 - 16amp. socket. If you have several units or you are not sure about power supply, please contact us on email Funnyland.uk@gmail.com / live chat to find the best solution.
- 8.4. After installation is finished and equipment is plugged in, The Hirer MUST NOT to turn off our wires, move them to another sockets, add his own extension leads or do any other manipulations with power supply of our equipment
- 8.5. Generally, we use 15m.extension leads and for one event is 2 of them so when coming to you on event day we will have 30m. of cables. If you need more, please contact us on email/live chat to find the best solution.
- 8.6. In case The Hirer decides to use his own or rent generator you must let The Company know about it prior event day.
- 8.7. In case The Hirer decides to use his own or rent generator you must count the power of generator by 2kw. per unit.
- 8.8. If The Hirer uses generator and it needs to be shut down (eg. to refill) first thing you need to make sure no one is on the inflatable, then turn off the blower and only then you can do what you need to do with generator or any other power supply point.
- 8.9. If The Hirer uses generator, The Hirer is responsible to check the fuel level on time (we recommend to never go under ¼ of fuel tank).
9. Health and Safety:
- 9.1. When placing an order, The Hirer is responsible to check and understand all Health and Safety documentation from us and from your venue for the date of the event. The Hirer can always reach us to get all copies of our documentation like Testing, Insurance and Risk assessments, by email Funnyland.uk@gmail.com or by contacting our live chat services. If you have any questions, please contact us before booking. In case of any restrictions placed on The Hirer after making an order to which The Hirer didn’t notify The Company of at the time of placing order and placed in writing with The Hirer will not be accepted as a valid cancellation reason so regular cancellation fees will be applied.
- 9.2. Due to renewal or testing dates these may become out of date for your event date. Once new documentation is received The Hirer can request new copies.
- 9.3. All equipment must be supervised at all times by at least one responsible and competent adult over the age of 18 years old. In case you have several equipment units you will need at least one responsible and competent adult over the age of 18 years old for each unit. Ignoring this advice means The Hirer takes full responsibility for any risks while using equipment.
- 9.4. The clothing must be appropriate and adequate for using this type of leisure. Socks MUST be on, all exposed skin is covered to avoid burns, injury or friction burns. The Company doesn’t take any responsibility for any traumas or injuries caused by avoiding rule above.
- 9.5. Shoes, ear rings or any other kind of piercing (if possible, to take them off), any kind of jewellery, necklace chain or beads are not allowed to wear at all times while using equipment. The Company doesn’t take any responsibility for any traumas or injuries caused by avoiding rule above.
- 9.6. Also, toys (except small soft toys) and glasses (except safe, breakproof flexible glasses), silly string, streamers, painted faces, henna, confetti, any food, drink, chewing gum, sweets, washing up liquid or any form of washing substance, are not allowed at all times during all time of event. The Company doesn’t take any responsibility for any traumas or injuries caused by avoiding rule above. The Hirer is responsible to give equipment back in clean, unbroken condition otherwise extra fees may apply.
- 9.7. It is not allowed to use any liquids (generally water) on the inflatable. This includes toy water pistols, garden sprinklers, hose pipes, buckets etc. Applying water on inflatable makes it extremely slippery and significantly increases risk of danger to the users of inflatable. The Company doesn’t take any responsibility for any traumas or injuries caused by avoiding rule above.
- 9.8. If needed to apply any kind of safety barriers around equipment it can be done by The Hirer and it is The Hirers responsibility to supply and operate them.
- 9.9. The Hirer is responsible for ensuring that there are adequate First Aid facilities available at the event place for in case of an Emergency
- 9.10.The Company reserves the right to remove or stop operating any equipment where it is felt the conduct of guests endangers the safety of other guests or users or for any other reason the company may see fit. In these cases, no refund will be offered.
10. Liability and Insurance:
- 10.1.If you require a copy of our Public Liability insurance for your venue/hall please contact us prior to your event date by email Funnyland.uk@gmail.com or by our live chat services, as these documents are not always available from delivery team.
- 10.2.The Company provides Public Liability insurance of £2 million pounds which cover the equipment only. Users are not getting insured while using our equipment. It is The Hirers responsibility to ensure that the users are insured correct way to cover every aspect that could arise. This may include accidents to the users and the public
- 10.3.We can not allow The Hirer to pick up and/or return equipment by themselves. Because any unauthorised equipment setting up/down will cause our Public Liability insurance can be deemed invalid.
- 10.4.The Hirer agrees to indemnify The Company for any damage or theft of the company's equipment whilst on hire. Our Public Liability insurance theft cover doesn't cover our equipment whilst on hire therefore the client is responsible for the cost of repair or replacement in full.
- 10.5.The Hirer agrees to indemnify The Company from any claims including but not limited to property damage, accident or injury claims for users or the public.
11. Prices, Payment, Quotes and Deposit:
- 11.1.The Company is contactless only payment company. That means all payments will go through Square pay, Google pay or Apple pay.
- 11.2.All booking fees as same as deposits will not be refunded in case of cancellation.
- 11.3.All prices you can find on our website or on our Facebook or Instagram are subject to change without any prior notice
- 11.4.For all orders / bookings deposit must be paid in amount of 25%.
- 11.5.All orders / bookings without paid deposit will be not counted as valid and will be cancelled.
- 11.6.All orders / bookings (except weddings) full balance of monies must be paid in full 7 working days before the event. Exemptions may apply if a written agreement between The Hirer and The Company was reached.
- 11.7.For weddings, payment of the full amount is required 6 weeks prior to the event date. Exemptions may apply if a written agreement between The Hirer and The Company was reached.
- 11.8.This company does not provide credit. All outstanding balances must be settled in full before the event. Failure to pay may lead to legal action to recover the owed amount, plus interest at a rate of 8% above the Bank of England current base rate.
- 11.9.An administration fee of £40.00 will be added to the outstanding balance for debts up to £999.99, £70.00 for debts up to £9,999.99 or £100.00 for debts £10,000.00 or above.
12. Cancellations:
- 12.1.Under UK law, consumers generally have a 14-day cooling-off period to cancel orders. However, this right doesn't apply to the hire of our products and services as they fall under the leisure services exemption. This exemption exists to protect businesses with limited availability, such as ours, as we cannot easily resell or replace bookings once made. While other companies in this sector may offer cancellations, Funny Land Ltd. does not allow cancellations for specific product or service hires on particular dates.
- 12.2.Cancellation fees will be charged based on the following schedule:
- 12.2.1.If you cancel more than 8 weeks before the event, a 25% fee will apply.
- 12.2.2.If you cancel between 4 and 8 weeks before the event, a 50% fee will apply.
- 12.2.3.If you cancel within 1 week of the event, the full invoice amount will be due to pay.
13. Problems, Complaints, Dissatisfactions:
- 13.1.If you are dissatisfied with any part of our equipment or service upon delivery, please inform our delivery team and withhold your signature until the issue is resolved to your satisfaction. By signing for the equipment, you confirm that it is in good working condition, suitable for its intended purpose, and that you are happy with the delivery location and service. Claims or refund requests made after this point will not be accepted.
- 13.2.Any damages or faults found on equipment on receipt of the goods must be reported to us via email or our live chat services within 2 hours. Failure to report any issues within this timeframe implies acceptance of the equipment's condition as fit for purpose.
- 13.3.Should you encounter any issues or dissatisfaction during your event, please inform us immediately by email or our live chat services. This will allow us to address the problem promptly. Any complaints raised after the hire period will not be considered.
Returning to the very beginning, make a booking with Funny Land Ltd ONLY IF YOU AGREE WITH ALL TERMS AND CONDITIONS PRESENTED ABOVE.
